Terms of Service
Effective: August 2026
These Terms govern your use of DrCarePro and form a binding agreement between your organisation and DrCarePro. By accessing or using the Service, you confirm that you have authority to accept these Terms on behalf of your organisation.
The service
DrCarePro provides a cloud-based Hospital Management System — including OPD management, patient EMR, prescriptions, pharmacy billing, IPD, and laboratory modules — to healthcare organisations in India. Feature availability may evolve; material reductions in scope will be communicated with reasonable advance notice.
Accounts and access
You are responsible for maintaining the confidentiality of account credentials and for all activity that occurs under your account. Suspected unauthorised access must be reported to us promptly at support@drcarepro.net. Each subscription entitles a single legal entity to use the platform; multi-location deployments require a separate agreement.
Subscription and billing
Subscriptions are billed in advance on a monthly or annual cycle in Indian Rupees. Payment is due at the commencement of each billing period. Accounts with overdue balances beyond 7 days may be suspended. Pricing adjustments take effect with 30 days' written notice.
Refunds
A full refund is available upon request within 7 days of the initial subscription purchase. Subsequent billing periods are non-refundable except where required by applicable law.
Data ownership
All clinical, operational, and patient data entered into DrCarePro remains the property of your organisation. DrCarePro processes this data solely to provide the Service and does not claim any ownership or independent right to use it.
Data portability
You may export your data in supported formats at any time from within the platform. Following termination, your data remains accessible for export for 90 days, after which it is permanently deleted from our systems.
Acceptable use
You agree not to resell or sublicense access to the platform; reverse-engineer, decompile, or create derivative works of the Service; use the platform to process data on behalf of third parties outside your organisation; or conduct load testing or security assessments without prior written authorisation.
Service availability
We target 99.5% monthly uptime. Scheduled maintenance will be communicated at least 24 hours in advance where operationally feasible. We are not liable for interruptions attributable to factors outside our reasonable control, including failures of third-party infrastructure, network providers, or force majeure events.
Intellectual property
The DrCarePro name, platform, and associated materials are proprietary to DrCarePro and protected under applicable intellectual property law. These Terms confer no ownership interest in the Service.
Limitation of liability
DrCarePro's aggregate liability arising under or in connection with these Terms shall not exceed the total fees paid by your organisation in the three months preceding the claim. In no event shall either party be liable for indirect, incidental, special, or consequential damages. DrCarePro is a practice management platform and does not constitute or substitute medical advice; clinical judgement remains the responsibility of qualified healthcare professionals.
Termination
Either party may terminate the subscription at any time. You may cancel via account settings or by written notice to support@drcarepro.net. We may suspend or terminate access immediately upon material breach of these Terms or as required by law.
Governing law and disputes
These Terms are governed by the laws of India. Any dispute arising from or relating to these Terms that cannot be resolved by mutual agreement shall be subject to the exclusive jurisdiction of the competent courts of Chennai, Tamil Nadu.
Amendments
We may amend these Terms from time to time. Material changes will be communicated to registered account holders by email at least 14 days before the effective date. Continued use of the Service after that date constitutes acceptance of the revised Terms.
